These Terms of Service outline how we work, create, and care for every project and relationship within the Black Ember community.
Please read these Terms carefully before using the Black Ember website or any related services. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with any part of the Terms, please refrain from using the Service.
Black Ember operates as a creative brand offering services through Black Ember Press and Black Ember Photography, including publishing, photography, and e commerce. Our work is centered on authentic storytelling, healing, and creative growth. You must be at least 18 years old to use the Service, or have the consent and supervision of a parent or legal guardian if under 18.
You agree not to use the Service for any unlawful purpose or in any way that disrupts, damages, or interferes with its operation. This includes violating any applicable law, infringing on intellectual property rights, or transmitting harmful or malicious software.
All content on this website, including text, images, graphics, logos, designs, and creative works associated with Black Ember and Black Ember Press and Black Ember Photography, is the property of Black Ember or its licensors and is protected by applicable intellectual property laws.
For photography services, Black Ember Photography retains copyright ownership of all original photographs but grants clients a non exclusive, perpetual license for personal, non commercial use unless otherwise agreed to in writing. For publishing services, authors retain full copyright ownership of their original manuscripts. Black Ember Press acts as a service provider offering editorial, design, and publishing support, or as a publisher only when governed by a separate written agreement.
A deposit or full payment is required to secure any booked service. For custom projects such as publishing or event coverage, a written quote will be provided after an initial consultation, and work will begin only after written approval and receipt of the required payment. If a client cancels a booked service, any paid deposit or retainer may be non refundable as compensation for time reserved and business opportunity lost. Black Ember reserves the right to reschedule or cancel services due to unforeseen circumstances. In such cases, clients will be offered either a rescheduled date or a full refund.
All e commerce orders are subject to product availability. All book, print, and digital sales are final. If a physical item arrives damaged or defective, please contact Black Ember within 14 days of delivery with photographic evidence to request a replacement.
The Service is provided on an “AS IS” and “AS AVAILABLE” basis. Black Ember makes no representations or warranties of any kind, express or implied, regarding the operation of the Service or the information, content, or materials included. Black Ember shall not be liable for any damages arising from the use of the Service, including direct, indirect, incidental, punitive, or consequential damages.
These Terms are governed by the laws of the State of Oregon, United States, without regard to conflict of law provisions. Black Ember reserves the right to modify or replace these Terms at any time. If a revision is material, reasonable efforts will be made to provide at least 30 days’ notice before updated Terms take effect.
